Il nuovo comma 5-bis dell\u2019articolo 7 del D.Lgs. 546\/1992 introdotto dalla Legge 130\/2022\u00a0 statuisce che la previsione relativa all\u2019onere della prova nel processo tributario comporta una nuova regola di giudizio che conduce all\u2019annullamento dell\u2019atto impositivo se la prova della sua fondatezza manca o \u00e8 contraddittoria, o se \u00e8 comunque insufficiente a dimostrare la pretesa in modo circostanziato e puntuale.<\/p>\n
